De ah\u00ed que en esa Constituci\u00f3n se incorpor\u00f3 una disposici\u00f3n para prohibir la reelecci\u00f3n presidencial inmediata (Art\u00edculo 82), algo que es ignorado.<\/p>\n<p>As\u00ed lo expresa Daniel Olmedo, abogado salvadore\u00f1o y M\u00e1ster en Derechos Fundamentales por la Universidad Carlos III de Madrid, en su aproximaci\u00f3n de la continuidad a la que aspira el presidente Nayib Bukele y que tanto resquemor causa en el espectro judicial y la oposici\u00f3n salvadore\u00f1a.<\/p>\n<p>\u201cLa duraci\u00f3n del per\u00edodo presidencial ser\u00e1 de cuatro a\u00f1os; y el ciudadano que hubiere ejercido la Presidencia en propiedad, no podr\u00e1 ser reelecto ni electo Vice-Presidente sino despu\u00e9s de haber transcurrido igual per\u00edodo que comenzar\u00e1 y concluir\u00e1 el 1 de marzo del a\u00f1o de la renovaci\u00f3n, sin poder funcionar un d\u00eda m\u00e1s\u201d, dice Olmedo en un art\u00edculo en la revista Factum.<\/p>\n<p>La prohibici\u00f3n de la reelecci\u00f3n presidencial inmediata, agrega, no era algo nuevo. Las constituciones previas (1841, 1871, 1872 y 1880) tambi\u00e9n conten\u00edan esa proscripci\u00f3n.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-266754 alignright\" src=\"https:\/\/theprisma.co.uk\/wp-content\/uploads\/2023\/10\/Democracia-elecciones-Pixabay.jpg\" alt=\"\" width=\"514\" height=\"342\" srcset=\"https:\/\/theprisma.co.uk\/wp-content\/uploads\/2023\/10\/Democracia-elecciones-Pixabay.jpg 1280w, https:\/\/theprisma.co.uk\/wp-content\/uploads\/2023\/10\/Democracia-elecciones-Pixabay-300x200.jpg 300w, https:\/\/theprisma.co.uk\/wp-content\/uploads\/2023\/10\/Democracia-elecciones-Pixabay-1024x682.jpg 1024w, https:\/\/theprisma.co.uk\/wp-content\/uploads\/2023\/10\/Democracia-elecciones-Pixabay-431x287.jpg 431w, https:\/\/theprisma.co.uk\/wp-content\/uploads\/2023\/10\/Democracia-elecciones-Pixabay-862x574.jpg 862w\" sizes=\"auto, (max-width: 514px) 100vw, 514px\" \/>Pero el problema de gobernantes con vocaci\u00f3n de permanencia era tan recurrente que se puso una disposici\u00f3n categ\u00f3rica (p\u00e9trea), que no diera lugar a debate.<\/p>\n<p>Cuando se decidi\u00f3 incorporar el \u201cni un d\u00eda m\u00e1s\u201d en la Constituci\u00f3n de 1886 se hizo sobre la base de una lucha hist\u00f3rica de El Salvador contra los intentos de presidentes de permanecer en el poder, agreg\u00f3.<\/p>\n<p>Esa expresi\u00f3n \u2013subraya- trascendi\u00f3 y contin\u00faa vigente en la Constituci\u00f3n de hoy (Art\u00edculo 154), por lo que el per\u00edodo presidencial ser\u00e1 de cinco a\u00f1os y comenzar\u00e1 y terminar\u00e1 el d\u00eda 1 de junio, sin que la persona que ejerci\u00f3 la Presidencia pueda continuar en sus funciones ni un d\u00eda m\u00e1s.<\/p>\n<p>Lo que plantea Olmedo adem\u00e1s es valorado por numerosos letrados y partidos opositores, o sea, la prohibici\u00f3n de la reelecci\u00f3n presidencial inmediata no solo se aborda en esa disposici\u00f3n tan clara, tambi\u00e9n en otras.<\/p>\n<p>Como otros analistas, Olmedo se\u00f1al\u00f3 que en por lo menos, cinco art\u00edculos constitucionales m\u00e1s (Arts. 75, 88, 131 ord. 16\u00ba, 152 y 248) hay un claro abordaje del tema. Adem\u00e1s est\u00e1 respaldada por una historia salvadore\u00f1a de permanente lucha contra la reelecci\u00f3n que, en textos constitucionales, se remonta por lo menos hasta 1841.<\/p>\n<p>Y fueron dos sentencias de la Sala de lo Constitucional de la Corte Suprema de Justicia (163-2013 y 6-2020), las que terminaron de sellar que la reelecci\u00f3n presidencial inmediata est\u00e1 prohibida en El Salvador.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-208993 alignright\" src=\"https:\/\/theprisma.co.uk\/wp-content\/uploads\/2021\/05\/Thoughts-huevo-martillo-dominacion-represion-hegemonia-Pixabay.jpg\" alt=\"\" width=\"513\" height=\"427\" srcset=\"https:\/\/theprisma.co.uk\/wp-content\/uploads\/2021\/05\/Thoughts-huevo-martillo-dominacion-represion-hegemonia-Pixabay.jpg 692w, https:\/\/theprisma.co.uk\/wp-content\/uploads\/2021\/05\/Thoughts-huevo-martillo-dominacion-represion-hegemonia-Pixabay-240x200.jpg 240w, https:\/\/theprisma.co.uk\/wp-content\/uploads\/2021\/05\/Thoughts-huevo-martillo-dominacion-represion-hegemonia-Pixabay-66x55.jpg 66w, https:\/\/theprisma.co.uk\/wp-content\/uploads\/2021\/05\/Thoughts-huevo-martillo-dominacion-represion-hegemonia-Pixabay-650x541.jpg 650w\" sizes=\"auto, (max-width: 513px) 100vw, 513px\" \/>El jurista precisa que el pa\u00eds pas\u00f3 por cap\u00edtulos dolorosos para defender la alternabilidad en el ejercicio de la presidencia: la dictadura de Maximiliano Hern\u00e1ndez Mart\u00ednez, una dictadura de partido militar, y una guerra civil.<\/p>\n<p>Hoy cuando el TSE ya confirm\u00f3 las candidaturas de seis aspirantes, incluido Bukele, la legitimidad y legalidad de la reelecci\u00f3n se mantendr\u00e1 cuestionada en los pr\u00f3ximos meses, tal vez despu\u00e9s del 4 de febrero de 2024, como un tema de controversia y de fricci\u00f3n, ya que para muchos analistas y expertos est\u00e1 prohibida.
