Estos activistas se han unido para poner de relieve las arraigadas desigualdades de g\u00e9nero en las leyes marroqu\u00edes, especialmente en el sistema de justicia penal, y han trasladado sus preocupaciones directamente al ministro de Justicia, Abdellatif Ouahbi. Ahora esperan reformas cruciales.<\/p>\n

El C\u00f3digo Penal marroqu\u00ed proh\u00edbe terminantemente el aborto, excepto cuando lo practica un m\u00e9dico autorizado en circunstancias espec\u00edficas para salvaguardar la vida de la mujer. Esta postura legal no s\u00f3lo restringe la autonom\u00eda reproductiva de las mujeres, sino que tambi\u00e9n pone en peligro su salud y bienestar. Seg\u00fan una entrevista de Amnist\u00eda Internacional con un m\u00e9dico de Marruecos: \u00ab\u00bfQu\u00e9 podemos hacer como m\u00e9dicos? Nada. No podemos ayudar a las mujeres. Tenemos las manos atadas. Estamos frustrados porque no podemos dar a las mujeres la ayuda que quieren\u00bb.<\/p>\n

\"\"<\/em>Adem\u00e1s, las v\u00edctimas de violaci\u00f3n se ven obligadas a gestar embarazos resultantes de agresiones sexuales, lo que les inflige traumas duraderos. Las j\u00f3venes madres solteras se enfrentan a tasas alarmantes de suicidio debido a embarazos no deseados. Seg\u00fan PAMJ – One Health, el 61,3% de las j\u00f3venes madres solteras en estas situaciones se plantean o intentan suicidarse, lo que pone de relieve la extrema necesidad de un acceso seguro y legal al aborto.<\/p>\n

El art\u00edculo 490 del C\u00f3digo Penal marroqu\u00ed penaliza las relaciones sexuales consentidas fuera del matrimonio, lo que impide a las v\u00edctimas denunciar las agresiones por miedo a las repercusiones legales y al estigma social. Esta disposici\u00f3n perpet\u00faa las desigualdades de g\u00e9nero y dificulta el acceso a la justicia de las v\u00edctimas de agresiones sexuales. Muchas v\u00edctimas temen ser acusadas y encarceladas en virtud del art\u00edculo 490 si no consiguen demostrar la violencia sexual que han sufrido.<\/p>\n

\"\"<\/em>Mientras tanto, el art\u00edculo 486 incorpora muchas discriminaciones relativas al periodo de reclusi\u00f3n penal, distinguiendo entre si la v\u00edctima de la violaci\u00f3n es menor, discapacitada o virgen. Tampoco aborda la violaci\u00f3n conyugal, lo que deja a innumerables mujeres expuestas a sufrir abusos dentro de sus propios matrimonios. Este sesgo sist\u00e9mico se traduce a menudo en condenas poco severas para los agresores, como se vio en el caso de tres hombres que recibieron penas de prisi\u00f3n de entre 18 meses y 2 a\u00f1os por violar repetidamente a una ni\u00f1a de 11 a\u00f1os, acto que la dej\u00f3 embarazada.<\/p>\n

Adem\u00e1s, el art\u00edculo 489 penaliza los actos sexuales entre personas del mismo sexo con penas de prisi\u00f3n de 6 meses a 3 a\u00f1os y multas de 200 a 10.000 Dhs. Esto no s\u00f3lo atenta contra las libertades individuales, sino que refuerza un marco heteronormativo que margina a las personas LGBTQ+. Esta represi\u00f3n legal forma parte de un sistema m\u00e1s amplio que oprime a todos aquellos que se salen del marco binario de g\u00e9nero. Al criminalizar las relaciones entre personas del mismo sexo, la comunidad LGBTQ+ queda expuesta a una dura realidad.<\/p>\n

\"\"<\/em>La lucha por la igualdad de g\u00e9nero y la justicia en Marruecos exige amplias reformas legales y cambios sociales. Requiere el empoderamiento de las mujeres, la protecci\u00f3n de sus derechos y la eliminaci\u00f3n de las leyes discriminatorias. Es imprescindible abordar estas leyes para garantizar la libertad individual, la igualdad de derechos y la emancipaci\u00f3n de la mujer.<\/p>\n
