Diaspora in limbo

In 2012, the then-president Barack Obama filled with hope thousands of young people who were in this land without the papers to authorise it. However, a few days ago a US court declared this initiative illegal and remanded the case to a lower court. Today, they are waiting while other people decide their future. 

 

The denounced initiative is the Consideration of Deferred Action for Childhood Arrivals, (DACA) which has benefitted more than 800,000 irregular immigrants who live in the United States, allowing them to access government help with their studies at schools and universities.

In fact, DACA’s goal is to prevent the deportation of hundreds of thousands of immigrants who arrived in the country as children.

However, today their destiny is on hold following an appeals court request that a lower court examine the changes to the rules introduced by President Joe Biden’s government. The Action will be reviewed by a federal district judge in Texas. The ruling issued by the Fifth Circuit Court of Appeals, based in New Orleans, thus forbids the incorporation of new applications, although it keeps up the entitlements for those who are already relying on it.

Likewise, it confirmed the status of illegality conferred on the program last year by the Texas district judge, Andrew Hanen, who stated that the initiative had not been subjected to the periods of public notice and commentary required by the federal Administrative Procedure Act.

Last July, the Justice Department defended the proposal, arguing that those benefitting from DACA would grow up to become productive drivers of the economy.

However, nine states with Republican tendencies argued about financial damages when immigrants are allowed to stay in the country, saying that hundreds of millions of dollars were spent on their medical attention, education and other costs. In a statement, the White House described the court judgement as the result of the efforts of conservative officials to strip the DACA beneficiaries of the protections and work permits that many have enjoyed for a decade.

This challenge is just another example of the extreme agenda driven by the republican officials of MAGA (Make America Great Again), the report added.

Despite this, analysts state that Biden’s administration did not do everything in its power to refine the policy, and maintain that it disappointed some of DACA’s defenders with its legal strategy of keeping unchanged the age requirements to obtain the benefits of the ruling.
