International Humanitarian Law violations in Palestine on trial

On the 27th July the International Opinion Tribunal (Trino) will meet to deliver an opinion on human rights violations in the Gaza Strip. Experts from six Latino-American countries will give their verdict on the critical situation in the Middle East.

On the 27th July 2024 the International Opinion Tribunal (Tribunal Internacional de Opinion, Trino) will meet to deliver an advisory opinion on violations of Human Rights and International Humanitarian Law in Palestine committed since October 7th 2023.

The hearing, which will be in public, will take place virtually and be transmitted online in real time. Magistrates from several Latin-American countries who have been in permanent session for the last three months will take part.

The Tribunal’s work will serve as material for clarifying the truth about grave violations of Human Rights which have taken place in the Gaza Strip and will constitute an instrument guiding the formation of national and international public opinion, determining – in a non-judicial manner – the political responsibility for these violations.

As a result of the Tribunal session a judgement will be delivered which cannot be appealed and will be notified to judicial courts. It will be transmitted to international public opinion through all available media.

In addition, copies of the judgement will be sent to the International Criminal Court, the UN Human Rights Council, the Interamerican Court of Human Rights, the Secretary General of the UN António Guterres, and to Amnesty International, among other organisations.

The Tribunal, whose president is Dr. Luis Bernardo Díaz Gamboa, will include magistrates from Colombia, Argentina, Brasil, Guatemala, Chile and México.

Among this interdisciplinary group of magistrates are defenders of human rights, academics, trade union leaders, and well-known lawyers such as: Lurdinha Ginetti, from Brasil; Ixkik´ Chajal Siwan, of the Maya K´iche´ people; Alicia Cabezudo, from Argentina; Guido Asencio, from Chile, and Andrés Eduardo Forero Sandoval, from México. From Colombia there are Clara Inés Domínguez García, Eduardo Kronfly, Camilo Andrés Rodríguez, Cristian Ibarra, Daniel Bernal and Jaime Araujo Rentería, ex-president of the Constitutional Court.

The prosecutor will be Carlos Meneses, of the American Association of Lawyers (AAJ), and for the defence German Guevara, a well-known trial lawyer. At the present time the following people have confirmed their presence either as parties or interveners: the Palestinian Ambassador to Colombia, Rauf Al Malki; el representative of the Parliament, Pedro José Suárez Vacca; the medical doctor and journalist, Víctor de Currea-Lugo; the writer Jorge Restrepo Fontalvo; the representative of the Institute of Humanitarian Studies (IEH), José Pascual Mora; the specialist in these matters, Pedro Pablo Salas, and the academic Gustavo Zuloaga, among others.

The Tribunal is supported and promoted by the Faculty of Law and by the Primo Levi Investigation Group of the Pedagogical and Technical University of Colombia (UPTC). It is a social-juridical agency of civil society that offers a specialized forum for analysis and the issuing of consultative opinions on juridical, ethical, economic, social, pedagogical and cultural matters that are of international relevance.

It originated in the Russell Tribunal, also known as the International War Crimes Tribunal, which was set up to judge crimes committed by the United States in Vietnam in 1966. Since then, there have been other Russell Tribunals to consider dictatorships in the southern cone of South America.
